La responsabilità sportiva: Con la definizione "responsabilità sportiva" l'autore intende tutte le varie aree di responsabilità (civile, penale, fallimentare, tributaria e disciplinare) che possono configurarsi nell'esercizio di attività sportive. Dopo un primo capitolo dedicato alla delimitazione dei concetti di ordinamento sportivo e di responsabilità sportiva e al loro rapporto con l'ordinamento statale, il volume tratta dettagliatamente, alla luce delle più recenti tendenze giurisprudenziali e dottrinali, della responsabilità civile e penale di atleti, organizzatori di manifestazioni sportive, gestori di impianti sportivi, medici sportivi, arbitri, allenatori, istruttori, genitori e società sportive. Ampio spazio è dedicato all'analisi della responsabilità oggettiva in materia sportiva, alla legge n. 401/1989 (con le recentissime modifiche apportate dalla legge n. 377/2001) sulla frode sportiva e sulle misure repressive della violenza negli stadi, alle disposizioni cogenti dell'ordinamento statale e ai regolamenti sportivi in materia di doping, con i più recenti contributi della dottrina e le più significative pronunce della giurisprudenza in materia. Per completare il vasto ma disorganico ambito della "responsabilità sportiva", vengono esaminati i principi e la casistica della responsabilità amministrativa e contabile del C.O.N.I., delle Federazioni sportive e dei loro dipendenti.
By the definition "sports liability" the author means all the various areas of liability (civil, criminal, bankruptcy, tax and disciplinary) that can occur in the exercise of sporting activities. After a first chapter dedicated to the delimitation of the concepts of sports system and sports responsibility and their relationship with the state system, the volume deals in detail, in the light of the most recent jurisprudential and doctrinal trends, with the civil and criminal liability of athletes, organizers of sports events, managers of sports facilities, sports doctors, referees, coaches, instructors, parents and sports clubs. Ample space is dedicated to the analysis of strict liability in sports matters, to Law No. 401/1989 (with the very recent amendments made by Law No. 377/2001) on sports fraud and repressive measures against violence in stadiums, to the mandatory provisions of the state system and to the sports regulations on doping, with the most recent contributions of the doctrine and the most significant pronouncements of the jurisprudence on the subject. To complete the vast but disorganized scope of "sports responsibility", the principles and cases of the administrative and accounting liability of the C.O.N.I., the sports federations and their employees are examined.
