Il regolamento, le tabelle e le spese: Il volume ha l'obiettivo di offrire, agli operatori del settore ed ai cultori della disciplina, un'elaborazione unitaria delle attuali tematiche relative al "nuovo condominio", così come riformato dalla legge n. 220/2012 e come ridisegnato dalla giurisprudenza (specie di legittimità) che, a più riprese, è intervenuta in materia. L'opera è divisa in tre parti. Nella prima, dedicata al regolamento di condominio, si analizzano le tipologie esistenti (assembleare e contrattuale) ed i variegati contenuti, passando, poi, in rassegna i limiti della potestà regolamentare e le possibili ipotesi di intervento dell'autorità giudiziaria. La seconda parte, avente ad oggetto le tabelle millesimali, una volta messe in luce le caratteristiche giuridiche e tecniche di questo peculiare "strumento" della gestione condominiale, esamina i casi di modifica e di revisione da parte dell'assemblea e del magistrato. La tematica relativa alle spese condominiali è trattata nella terza parte, dove si approfondisce il fondamento giuridico dell'obbligo di contribuzione e si espongono i vari criteri legali di ripartizione, cogliendo l'occasione per perimetrare esattamente le attribuzioni dell'assemblea al riguardo. Particolare attenzione viene rivolta al complesso rapporto che intercorre, nell'ipotesi di inadempimento delle obbligazioni condominiali, tra l'amministratore, i singoli partecipanti (morosi e in regola con i pagamenti) ei terzi creditori.
The book has to offer, for professionals and enthusiasts of the discipline, uniform processing of current issues related to the "new condo" as well as reformed by law No 220/2012 and as redesigned by the case-law (sort of legitimacy) that, on several occasions, intervened in the matter. The work is divided into three parts. In the first, dedicated to the condominium regulations, we analyze the existing types (shareholders and contract) and the varied content, passing, then reviews the regulatory authority limits and possible hypothesis of intervention of the judicial authority. The second part, concerning the thousandths tables, once legal and technical characteristics of this peculiar "tool" of condominium management, examines the cases of review and revision by the Assembly and the magistrate. The issue concerning the condo fees is dealt with in part three, where the legal basis of the obligation of contribution and expose the various legal tests, taking the opportunity to exactly delimit the powers of the Assembly in this regard. Particular attention is paid to the complex relationship, in the event of breach of the obligations, between the administrator, individual participants (in arrears and outstanding payments) and third party creditors.
