Brevi note sull'errore giudiziario in Italia: Il rischio di errore giudiziario è un dato immanente in quasi in ogni indagine, anche in quella più accurata. Esso è presente in tutti gli ordinamenti del mondo ed è determinato da svariate e molteplici ragioni, sia tecniche giuridiche, sia dettate dalla sempre presente fallibilità umana. In questo lavoro, si affronterà il tema di quel particolare errore giudiziario che si pone specificamente sotto la soglia della colpa grave. Quell'errore giudiziario che non comporta mai alcuna responsabilità né per la polizia giudiziaria, né per i magistrati che ne sono stati gli inconsapevoli difensori, qualche volta artefici, comunque fornitori a esso di una paludata veste giuridica. Viene analizzato l'errore giudiziario nell'ottica della valutazione di quella particolare attività (insindacabile) da parte del magistrato volta all'interpretazione di norme di diritto, per la (discutibile ex post) valutazione del fatto, degli indizi e delle prove; spazi questi che non sono mai forieri per il decidente di sanzioni e\o risarcimenti ma che, contemporaneamente, con maggiore studio e approfondimento degli indizi e delle prove emergenti, avrebbero potuto essere umanamente evitati. The risk of miscarriage of justice is an immanent fact in almost every survey, even in the most accurate one. It is present in all the world's systems and is determined by a variety of reasons, both legal and dictated by the ever-present human fallibility. In this work, we will address the issue of that particular miscarriage of justice that is specifically placed below the threshold of serious guilt. That miscarriage of justice which never entails any responsibility for either the judicial police or the magistrates who were its unwitting defenders, sometimes architects, however suppliers to it of a paltry legal guise. The miscarriage of justice is analysed in view of the evaluation of that particular (unquestionable) activity by the magistrate aimed at the interpretation of legal rules, for the (questionable ex post) assessment of the fact, the evidence and the evidence ; these spaces that are never harpping for the decision-makers of sanctions and compensation but which, at the same time, with greater study and deepening of the clues and emerging evidence, could have been humanly avoided.
