Commentario al Testo Unico in materia di Foreste e Filiere forestali (d. lgs. 3 aprile 2018, n. 34): La disciplina giuridica del bosco e dell'impresa forestale, introdotta dal decreto legislativo 3 aprile 2018, n. 34 "Testo Unico Foreste e Filiere Forestali", prospetta molteplici profili innovativi rispetto alla precedente normativa contenuta nel decreto legislativo n. 227 del 2001, ora abrogato, che aveva coinvolto il bosco nel processo di ammodernamento e riordino della normativa inerente l'impresa agricola. Il Commentario, attraverso i contributi dei suoi Coautori, diversificati in funzione dei profili diversi della materia trattati dalla novella legislativa, esplora l'intera gamma degli strumenti che il Testo Unico plasma per cogliere la riaffermata valenza multifunzionale che connota il bosco come bene ad uso controllato, dalla rivisitazione di modelli antichi a quelli di nuovo conio, sullo sfondo di un rinnovato rapporto tra le funzioni dello Stato e quelle delle Regioni nel settore forestale, con riferimento anche all'analisi del poliedrico nuovo collegamento prospettato tra la sua disciplina e la stratificata normativa mirata a tutelare e valorizzare il paesaggio, contenuta nel Codice dei beni culturali e del paesaggio e nelle sue successive modifiche e integrazioni, sotto il duplice profilo del regime vincolistico e di quello pianificatorio; e nell'ottica di perseguire la finalità di garantire quella gestione forestale sostenibile, nella definizione disegnata dallo stesso Testo Unico, la quale rappresenta un fil rouge del suo dettato normativo.
The legal discipline of the forest and the forestry enterprise, introduced by Legislative Decree 3 April 2018, n. 34 "Consolidated Law on Forests and Forest Supply Chains", proposes multiple innovative profiles compared to the previous legislation contained in Legislative Decree no. 227 of 2001, now repealed, which had involved the forest in the process of modernization and reorganization of the legislation concerning the agricultural enterprise. The Commentary, through the contributions of its Co-authors, diversified according to the different profiles of the subject treated by the new legislation, explores the entire range of tools that the Consolidated Text shapes to grasp the reaffirmed multifunctional value that characterizes the forest as a good for controlled use, from the revisiting of ancient models to those of new coinage, against the background of a renewed relationship between the functions of the State and those of the Regions in the forestry sector, with reference also to the analysis of the multifaceted new link envisaged between its discipline and the stratified legislation aimed at protecting and enhancing the landscape, contained in the Code of Cultural Heritage and Landscape and in its subsequent amendments and additions, under the dual profile of the constraint regime and the planning regime; and with a view to pursuing the aim of ensuring sustainable forest management, in the definition drawn by the Consolidated Law itself, which represents a common thread of its regulatory dictate.
