La responsabilità genitoriale e l'affidamento dei figli: Il volume muove dalla constatazione che l'odierno diritto di famiglia, specie dopo le recenti riforme in materia di filiazione, piuttosto che dare rilievo al legame matrimoniale o di fatto della coppia, si preoccupa dei diritti dei figli e tratta unitariamente il loro rapporto con i genitori, senza che rilevi l'ambito in cui esso viene ad esistenza. Di ciò si ha piena evidenza solo se si consideri che le norme che disciplinano la responsabilità genitoriale sono oggi uniche per i figli nati nel o fuori del matrimonio, e che, coerentemente, quelle in materia di affidamento a seguito della crisi sono state collocate nell'ambito delle regole che governano la responsabilità genitoriale (artt. 337 bis-337 octies c.c.), alla stregua di mere specificazioni delle disposizioni ordinarie (art. 315 c.c.), con le quali reciprocamente si integrano. In questo quadro, che ha profondamente innovato la prospettiva tradizionale e richiesto una completa rivisitazione della materia, il volume ricostruisce il mutato contesto sistematico in cui si collocano i provvedimenti relativi all'affidamento dei figli ed analizza quindi in maniera approfondita le relative molteplici questioni, anche di carattere pratico, con costante riferimento al diritto vivente formatosi grazie agli apporti degli studiosi e della giurisprudenza di legittimità e di merito.
The volume starts from the observation that the current family law, especially after the recent reforms regarding filiation, rather than giving relief to the couple's marriage or de facto, cares for the rights of children and treats as a unit on their relationship with parents, without that detects the scope where it comes into existence. It has full evidence only if they consider that the rules governing parental responsibility are today only for children born in or out of wedlock, and that, accordingly, those concerning custody in the wake of the crisis have been placed within the rules governing parental responsibility (article 337 bis-337 g c.c.), as mere specifications of ordinary provisions (article 315 CC) that mutually complement. In this painting, which has deeply innovated the traditional perspective and prompted a complete review of the matter, the book reconstructs the changing systemic context in which are placed the measures on child custody and then analyzes in detail its various practical issues, even with constant reference to the living law formed thanks to contributions of scholars and jurisprudence of legality and merit.
